Scope of these terms
These terms apply to every quote, proposal and contract Casinys issues for office fit-out, refurbishment and design work. Where a signed project contract exists and conflicts with these terms, the contract wins. Nothing here removes rights you have under the Australian Consumer Law.
Casinys is the trading name used by the contractor named on your project contract, with its registered address at 60 Cremorne Street, Cremorne VIC 3121.
Quotes and pricing
Quotes are valid for 30 days unless a shorter or longer period is written on the quote itself. Prices assume the site conditions we saw during the survey. Where the work is lump sum, that figure holds unless you change the scope.
- All prices are in Australian dollars and exclude GST unless stated otherwise
- Provisional sums are shown as separate line items with the assumptions listed
- Any scope change is priced in writing before we proceed
- Price changes caused by a base building issue are handled as a variation, not an automatic increase
Project delivery
Programme dates are set in good faith based on trade availability at the time of contracting. They can move if the base building restricts access, if a permit application sits with council longer than expected, or if you delay a selection we need to order against.
We will notify you in writing as soon as we know a date will slip, with the reason and the revised date. Occupied sites and after-hours work may extend the programme and we will flag that during pricing.
Payment terms
Standard terms are 14 days from invoice date unless your contract states otherwise. Progress claims are issued at agreed milestones, usually deposit, mid-build and handover.
- A deposit is required before materials are ordered and site setup begins
- Progress claims are payable within the period shown on the invoice
- Interest may apply on overdue amounts at the rate allowed by law
- Work may pause if an invoice remains unpaid and we have sent two reminders
We retain title to unfixed materials until they are paid for.
Liability and defects
We carry public liability and contract works insurance for every project and will provide certificates on request. Our liability is limited to the value of the works under the contract, except where the law does not allow that limit.
Defects notified within the defects liability period stated in your contract are rectified at our cost. Defects caused by other trades, tenant misuse or base building failure are outside that period.
Governing law
These terms are governed by the laws of Victoria, Australia. Both parties agree to attempt good-faith negotiation before starting any formal proceeding, and to use the courts of Victoria if negotiation does not resolve the matter.
